Peter Churchman –Environment Court

Since 1985 Peter has had a significant environment/resource management practice. This has involved acting for developers, a major City Council, various community groups and individuals. For 15 years Peter was the senior resource management litigator for a large supermarket operator, Foodstuffs South Island Limited. This involved representing them in applications and hearings throughout the South Island. A typical case is Baker Boys Limited v Christchurch City Council [1998] NZRMA 433.

For some 15 years Peter was also the principal resource management law advisor for the Dunedin City Council.   Over that period Peter appeared in scores of cases before the Planning Tribunal/Environment Court. Some of the more notable ones were Wilhelmsen v Dunedin City Council [1992] 1 NZRMA 285; Hawkesbury Community Living Trust v Dunedin City Council [1992] 2 NZRMA 267 and Dunottar Limited v Dunedin City Council [1998] NZRMA 472. Since moving to Wellington Peter has continued appearing in resource management cases. These include the  successful challenge to a decision interpreting the foreshore provisions in District and Regional Plans in Lowry Bay Residents Association v Lower Hutt City Council and Others Environment Court unreported W45/2001 31 May 2001 and acting for the developer in the high profile Hilton Hotel case on Wellington's waterfront. (Intercontinental Hotel v Greater Wellington Regional Council W015/2008, 14 March 2008). This appeal involved complex issues around a hotel development in a sensitive waterfront site and the validity of relevant planning instructions.
