Peter Barker


Peter Barker is a commercial barrister advising on a wide range of commercial matters including insolvency and banking law.  Peter was previously a partner at Bell Gully for 25 years.
 
In addition to small business and corporate clients, Peter has also acted for specialist industry groups including the New Zealand Bankers’ Association, New Zealand Stock & Station Agents’ Association and the New Zealand Trade Development Board.  He has an extensive knowledge of banking operating procedures and the banking industry.
 
Peter has been an honorary solicitor to Asia 2000, is a past chairman of the Asean New Zealand Business Council and has been a member of Insol International since 1989.  Peter is currently a committee member of the Joint Insolvency Committee of the New Zealand Law Society and New Zealand Institute of Chartered Accountants which reviews and considers proposed changes to insolvency law.
 
Peter is listed in Euromoney’s, “World’s leading insolvency and restructuring lawyers” and recommended in respect of insolvency in the “Asia Pacific Legal 500” and “Global Counsel 3000”.


Experience


Drafted and negotiated contracts on a wide variety of matters for a number of clients in different industries.

Acted for individuals for company start-ups and providing strategic advice as to their development.

Acted for Electricity Corporation of New Zealand on its split into Meridian, Genesis and Mighty River Power.

Provided advice to directors and senior management of both public and private companies in respect of their duties particularly where a company was under financial stress.

Acted as the main outside lawyer to a major bank for over 20 years on all its legal matters including acting on its acquisitions and dispositions, preparing standard form security documentation, reviewing advertising for legal compliance, acting on numerous one-off banking transactions and in the recovery of troubled loans.

Acted for the initial statutory managers of DFC New Zealand Limited and all the subsequent statutory managers on most major aspects of its statutory management until the cessation of the statutory management.

Acted for receivers and liquidators of insolvent companies in a wide variety of industries.

Acted for the independent accountant appointed by the Speaker of Parliament to provide a report in relation to the resignation of the then Auditor General, J T Chapman.

Acted as an expert witness for a foreign government in relation to its proposed introduction of anti-money laundering legislation.
